UN establishes a Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence


The Luisa Hairabedian Foundation and the Center for Legal and Social Studies (CELS) welcomes the UN Human Rights Council´s decision to establish a Special Rapporteur on the promotion of truth, justice, reparation and guarantees of non-recurrence. In line with the most recent developments of international human rights law, such as the entry into force of the International Convention for the Protection of All Persons from Enforced Disappearance, the establishment of the Special Rapporteur represents a positive sign of the international community in order to recognize the need of a comprehensive approach based on four basic pillars: truth, justice, reparation and guarantees of non-recurrence.
 
The experience of Argentina and other Latin American countries is reflected on this approach. Despite of the difficulties faced on each specific case, these countries were able to follow the path of justice in the fight against impunity for those responsible for crimes against humanity.
 
The Rapporteur will contribute with technical assistance for the development and implementation of measures to address human rights violations and preventing the recurrence of these crimes. Among other assignments, the Rapporteur will conduct country visits; identify and promote good practices and make recommendations to States. Furthermore, the creation of the new Special Rapporteur will foster the Human Rights Council to constantly promote and monitor the process of truth and justice.
 
The establishment of the Special Rapporteur was originally promoted by Argentina and Switzerland. Recently, other seventy countries from different regions around the world decided to cosponsor this initiative. As a result of this wide support, the resolution was adopted directly by consensus by the Human Rights Council, the principal human rights political body of the UN.
